The defense's argument is essentially that the company forced the men to work long hours and are therefore responsible for any errors that may have occurred. Alicia notices a discrepancy in another area however and they have only a few days to prepare a new defense. Alicia and Cary are interviewing for a new assistant. Alicia has also been arguing with her mother-in-law about the children and when they will visit their father. As tensions rise between them, she makes a point of telling her son that Alicia has been spending several late evenings with Will Gardner.
